Program Terms & Conditions

"Program" refers to any class, course, workshop, program or event run by Rise & Shine Debating. 

Agreement between the designated coach, teacher or servicer provider of Rise & Shine Debating (hereinafter referred to as “Rise & Shine”), and You, the representative of a student (hereinafter referred to as “The Client”), for work commencing in the capacity of Coach, Educator or Consultant.


CANCELLATIONS

A participant may cancel their booking for a class, workshop or program up to 14 days before the commencement of the class, workshop or program and receive a full refund. Participants who cancel their booking between 1 and 13 days before the commencement of the class, workshop or program, or after 1 session of a program, class or workshop will be refunded 70% of their full fee. 

No refunds are issued for students who withdraw once a class, workshop or program after 2 or more sessions. In the event that a participant needs to withdraw from a class or program due to illness or emergency, a partial refund may be given on compassionate grounds. These situations will be taken on a case-by-case basis and Rise & Shine Debating reserves the right to refuse a refund for withdrawal from a program once it has commenced and the participant has attended more than one session any reason.

  

Where the Client has booked the services of Rise & Shine on a specific day or time, for example for a scheduled 1-on-1pre-arranged coaching session, the hours will be blocked out to work for the Client without interruption. Exclusive Bookings are subject to the Minimum Charge, and if the booking is canceled within 24 hours of the booked day, the charge will still be invoiced.
 

PROGRAM NUMBERS

Rise & Shine programs, classes, events and workshops require minimum numbers to be met in order to run. In the event that a program does not meet the required numbers to proceed, a full refund will be provided to Clients for fees paid for that program. Rise & Shine reserves the right to cancel a program, class, event or workshop if minimum numbers are not met before the program commences. 


PAYMENT


Upfront payment is required for all Rise & Shine programs, workshops, classes and events. Students may not attend a program, workshop, class or event before full payment has been made. No discounts or refunds will be given if a student misses a session due to late payment. Rise & Shine reserves the right to refuse attendance to any student whose fees have not been paid. 

ENROLLMENT PROCESS


The Client must have completed a student enrolment form before a student may attend a Rise & Shine class, workshop, program or event. The enrolment form contains important details regarding medical conditions, contact numbers in case of emergency and other information vital to ensuring the safety and wellbeing of students. 

CONFIDENTIALITY


Rise & Shine agrees not to misuse or disclose any confidential information that may be made available by The Client.

CLIENT RESPONSIBILITIES


The Client agrees to read the Program Policies and sign the enrollment form stating that said policies have been read and agreed to before enrolling a student in a Rise & Shine class, workshop, program or event. 

LIABILITY


Rise & Shine makes every effort to maintain the highest possible work standards. However, we cannot accept responsibility for any loss, expense or liability of any kind incurred whilst preparing work for The Client in a consultation or coaching capacity. To the extent permitted by law, Rise & Shine shall not be liable to the Client or to any third party for any loss or damage arising directly or indirectly in connection with the provision of services. The Client will indemnify and holds harmless the Consultant from and against any claims, costs, expenses, negligence, actions or suits suffered, sustained or incurred by the Client or any third party. This includes, without limitation, interruptions caused by acts of Nature, or any other circumstances beyond reasonable control, any lost profits, business interruption, loss of data or otherwise, even if expressly advised of the possibility of such damages.

VARIATION IN TERMS
These terms can only be varied, amended or altered by written agreement between Rise & Shine and The Client.

Consultancy Terms & Conditions

When you engage Rise & Shine Debating to perform work in a coaching, educating or consultancy capacity, you will be required to accept the Rise & Shine Terms & Conditions.

Agreement between the designated servicer provider of Rise & Shine Debating (hereinafter referred to as “Rise & Shine”), and You, the authorised representative of “The Client” (hereinafter referred to as “The Client”), for work commencing in the capacity of Coach Educator or Consultant.

 

Rates will be confirmed in writing before work commences. If you've received a quote and signed a contract for a job, any work, changes or additional pages outside of the stipulated and agreed quote will result in an extra cost at an hourly rate of $99 p/h (or part thereof).


An invoice for the additional work will be sent ~ and require payment for ~ prior to the handover of the job. Further changes as requested after handover at an hourly rate of $99 p/h (or part thereof).

AGREED HOURLY RATE

The agreed hourly rate is to remain confidential between The Client and Rise & Shine, and Rise & Shine reserves the right to change this rate periodically. The Client will be informed in writing should this rate be changed during the term of this agreement.

PAYMENT


Rise & Shine invoice upfront for all work, and work will not commence until payment has been received.
For a 1-on-1 session, payment must be made prior to the session, an invoice will be sent or you can book and pay using a credit card here. Payment by The Client is required within 48 hours of receipt of any other invoices from Rise & Shine. Rise & Shine accepts payment by credit card and direct deposit (bank account details will be made available to you when the invoice is sent.)


CONFIDENTIALITY


Rise & Shine agrees not to misuse or disclose any confidential information that may be made available by The Client.

All reasonable care will be taken to ensure work is completed to the highest achievable standard however Rise & Shine will not be held liable for loss, expense or damage caused by any act or omission that occurs throughout the duration of the booking.

CANCELLATION / TERMINATION OF AGREEMENT


Should The Client wish to cancel/terminate the agreement and discontinue any work in progress, The Client must notify Rise & Shine immediately of this intention. Hours worked to that point will be invoiced (minimum 2 hours where an exclusive booking has been made). In the case of cancellation, outstanding invoices are required to be paid within 48 hours of the invoice issue date.

VARIATION IN TERMS


These terms can only be varied, amended or altered by written agreement between Rise & Shine and The Client.
